Background Defensive medicine is physicians’ deviation from standard medical care which is primarily intended either to reduce or avoid medico legal litigation. Although the Federal Ethics Committee review in Ethiopia has shown that applications for medical/surgical error investigation claims are increasing at an alarming rate, there is no study to date done to estimate the degree of defensive practice done by the physicians with an intention of avoiding this increasing legal claim. This study assessed the practice of defensive medicine among (...) highly litigious disciplines (surgery) and described factors associated with its practice. Methods Cross sectional quantitative study using online survey questionnaires was conducted to assess the degree of defensive practice and six factors (age, years of experience, specialty, monthly income, place of practice and previous medico legal history) associated with its practice were assessed among surgeons working in Ethiopia. Results A total of 430 surgeons directly received an online survey questionnaire and 236 of them successfully completed the questionnaire making the response rate 51.2%. Nearly half of the study participants (51.7%) were aware of the concept of defensive medicine and 174 (74%) reported performing one form of defensive practice. Twenty-nine (12.3%) of the participants have legal dispute history, though only 1.3% of them ended up in penalty. Avoiding high risk procedures was the commonest defensive act performed by 60% of the participants, followed by ordering tests unnecessarily (52.1%). Multinomial logistic regression model showed that there was no association between age of the participant, place of practice, year of experience and defensive practice. This model also showed that cardiothoracic and vascular surgeons perform less defensively than surgeons with other specialty with P value of 0.02. Conclusion The practice of defensive medicine is widespread among surveyed Ethiopian surgeons and further studies are required to objectively estimate the effect of defensive practice on the health care system of the country. Policy makers need to develop strategy towards decreasing this high rate of defensive practice. (shrink)

This paper investigates the effect of female representation on the board of directors on corporate response to stakeholders’ demands for increased public reporting about climate change-related risks. We rely on the Carbon Disclosure Project as a sustainability initiative supported by institutional investors. Greenhouse gas emissions measurement and its disclosure to investors can be thought of as a first step toward addressing climate change issues and reducing the firm’s carbon footprint. Based on a sample of publicly listed Canadian firms over the (...) period 2008–2014, we find that the likelihood of voluntary climate change disclosure increases with women percentage on boards. We also find evidence that supports critical mass theory with regard to board gender diversity. These findings reinforce initiatives being undertaken around the world to promote gender diversity in corporate governance while demonstrating board effectiveness in stakeholder management. (shrink)

Este artículo trata sobre la conquista de Libia y Túnez por Saladino y los Ayyubíes en las décadas de 1170 y 1180. En primer lugar se presenta una reconstrucción de las campanas dirigidas por los mamelucos ayyubíes Sharaf al-Din Qaraqush e Ibn Qaratikin en Libia y de la guerra entre los almohades y los Ayyubíes en Ifriqiya basada en fuentes primarias relevantes. A continuación se estudia en qué medida Saladino fue el responsable de estas expediciones militares y, finalmente, se discute (...) el motivo de dichas expediciones. Se llega a la conclusión de que Saladino y sus emires invadieron el Magreb con el fin de controlar los puntos septentrionales de los ejes oriental y central de las rutas comerciales que cruzaban el Sahara y con esto lograr tener acceso al oro de África Occidental que pasaba a lo largo de estas rutas. Esto ocurrió en un momento en que había una gran escasez de metales preciosos en Egipto y Saladino necesitaba efectivo para pagar sus guerras con los cruzados en Palestina. (shrink)

Et si l'on suit sa réflexion, à la question 'Qu'est-ce que le tragique?', on notera qu'il est une façon d'être au monde de manière spéculative. L'union des contraires, de la poésie et de la sagesse, (...) voilà ce qui a tant plu à Empédocle, Hölderlin et Nietzsche. BackgroundPreprint usage is growing rapidly in the life sciences; however, questions remain on the relative quality of preprints when compared to published articles. An objective dimension of quality that is readily measurable is completeness of reporting, as transparency can improve the reader’s ability to independently interpret data and reproduce findings.MethodsIn this observational study, we initially compared independent samples of articles published in bioRxiv and in PubMed-indexed journals in 2016 using a quality of reporting questionnaire. After that, we performed paired comparisons (...) between preprints from bioRxiv to their own peer-reviewed versions in journals.ResultsPeer-reviewed articles had, on average, higher quality of reporting than preprints, although the difference was small, with absolute differences of 5.0% [95% CI 1.4, 8.6] and 4.7% [95% CI 2.4, 7.0] of reported items in the independent samples and paired sample comparison, respectively. There were larger differences favoring peer-reviewed articles in subjective ratings of how clearly titles and abstracts presented the main findings and how easy it was to locate relevant reporting information. Changes in reporting from preprints to peer-reviewed versions did not correlate with the impact factor of the publication venue or with the time lag from bioRxiv to journal publication.ConclusionsOur results suggest that, on average, publication in a peer-reviewed journal is associated with improvement in quality of reporting. They also show that quality of reporting in preprints in the life sciences is within a similar range as that of peer-reviewed articles, albeit slightly lower on average, supporting the idea that preprints should be considered valid scientific contributions. This paper analyzes a non-temporal interpretation of the adverb sempre “always” in European Portuguese and Italian, in which the adverb expresses persistence of the truth of a proposition over time and displays specific contextual constraints (TP-sempre). Despite an overlap in the contexts in which TP-sempre may occur in both languages, we provide data showing that its distribution is not exactly the same in European Portuguese and Italian. In view of these data, we propose that TP-sempre is a modal operator of (...) confirmation in both languages, but that it is more restricted in Italian in that it has a plan presupposition only in this language. We review Potts' influential book on the semantics of conventional implicature , offering an explication of his technical apparatus and drawing out the proposal's implications, focusing on the class of CIs he calls supplements. While we applaud many facets of this work, we argue that careful considerations of the pragmatics of CIs will be required in order to yield an empirically and explanatorily adequate account.

Giorgio Agamben’s concepts of ‘the sovereign’, ‘state of exception’ and ‘bare life’ have been used by political theorists, particularly since the declaration of the Global War on Terror and during the more recent age of wars of humanitarian intervention, to conceptualize the sovereignty exercised by security states. These state processes have been mirrored by absolutization within some branches of political theory, conflating Foucauldian concepts of biopolitical sovereignty and circulatory governmentality with notions of absolutist rule, and narrowing optics for interpreting popular (...) mobilizations around gendered ‘human security’ projects, emergency regimes and moralizing repression. Suggesting more productive directions for theory, this article generates a close reading of female activists working in an unexpected industry in Egypt who have struggled to invert and subvert absolutist and moralizing framings and have generated their own theory through practice. The ‘Natashas of Cairo’ – well organized and transnationally linked belly dancers – successfully promoted gendered popular sovereignty in remarkable campaigns between 2002 and 2006, utilizing personal-rights litigation to create frameworks to render the absolutist state more accountable; establish labor solidarities that crossed international boundaries as well as class boundaries; and articulate an alternative moral regime for dance work that rejected both ‘pornification’ and the ‘respectability politics’ of professionalization. Science starts out with the idea of a person as billions of neurons housed in a body that is a cloud of particles. Common sense starts out with the idea of a person having capacities belonging to a single individual. The common sense person does not have parts. Our objectifying science slowly takes over the person as it tends toward physical materialism. Where will it end? What is being gradually pushed out of the world? If science had already taken over, (...) if the categories of neuroscience were complete, then it would be possible to speculate about its relation to earlier stages of thought. However, that is not the situation. The categories of science have yet to emerge. The puzzling character of new scientific objects reveals that we are on the threshold of profound conceptual change. The Humanities are at a crossroad. Do the Humanities scoff at the encroachment of science and risk the fate of those who resisted the Copernican revolution? Do they embrace the changes only to be burned at the stake like those who accepted the Copernican revolution? I suggest that the Humanities mobilize their collective power to create the categories in terms of which science will explicate the very idea of a person. Over the last fifty years, philosophers in the Kantian tradition have offered strategies for developing the new categories in humanistic terms. One approach follows “color” and “consciousness” through their passage from a common sense image of the world to a developing scientific image. It is a journey that illustrates the problems and the puzzles ahead. It indicates the perils of the next recategorization of the world. (shrink)

O presente artigo explica o que é e como funciona o método de análise lógica de Russell no contexto do atomismo lógico, apontando os objetivos e preceitos que ele leva em conta quando se propõe a fazer análises proposicionais. Após explorar o desenvolvimento geral da análise em sua obra, examinamos dois exemplos de análise proposicional: o de proposições relacionais e o de proposições que contêm descrições. Nos dois casos, notamos que Russell busca romper com uma lógica restrita à forma sujeito-predicado, (...) que ele pensava ser a origem de uma gramática defectiva e, por isso, também de muitos dos problemas metafísicos tradicionais. Neste sentido, presumindo que pode haver uma ampla variedade de formas, Russell pensa que o objetivo da análise seria justamente identificar qual é a forma lógica e quais são os constituintes de uma proposição, o que serviria para desfazer mal-entendidos da linguagem e dissolver problemas metafísicos. Portanto, no presente artigo, detalhamos sob quais preceitos teóricos Russell realiza esse objetivo nos dois exemplos especificados. (shrink)

Among late Renaissance and early Modern philosophers, the concepts of “sympathy” or “harmony” are a recurring theme. My goal is to show that theories which rely on such concepts, far from being an attempt to avoid the emerging mechanistic or empirical trends, are actually the form which these trends took in the wake of an increasing disenchantment with Aristotelian psychology. Fracastorius, Suarez and Descartes provide the texts: their accounts of the interaction between cognitive faculties exhibit a growing awareness that the (...) conception of causality had to be supplemented. And while each appears to share the general belief that aspects of the Thomistic-Aristotelian framework can survive the necessary changes, they disagree about how much dogmatic psychology has to be discarded. What they decide to leave in and the reasons given for discarding the rest provide insight into the history of explanation. It is in the metaphysics of harmony that we can trace the early growth of Rationalism. (shrink)

This article explores the traditional basis of modern human rights doctrines and exposes some of the systemic shortcomings. It then posits that a number of these problems are advanced via integrating some developments in the philosophy of science and substantive scientific research into legal philosophy. This article argues that supervening holism grounded in quantum mechanics provides an alternative basis to human rights by positing an ontological construct that is congruous with many of the wisdom traditions practiced around the world. This thesis considers the space of encounter between the quantum mechanical ontology of limited universal holism and the legal system. This space of encounter is identified through an examination of two premises. The first premise is that the ontological structure of limited universal holism has significant legal philosophical and socio-­‐legal implications. The second premise is that the loci of commitment within the ontology of limited universal holism epistemologically coheres with the core ontological notions that underpin the Preamble of the Universal (...) Declaration of Human Rights of 1948,1 specifically the notions of equality, universality and inalienability. Both premises are affirmed in the course of analysis undertaken in this thesis. In addition some novel contributions are posited. Some of the ontological elements of limited universal holism when deployed as heuristic tools show, inter alia, coherence between the way socio-­‐legal constructivists conceptualise the law and the wave-­‐particle duality of quanta. In respect of the second premise, epistemological coherence is shown between the ethos that underpins modern human rights and the loci of commitment within the ontology of limited universal holism. This coherence improves the epistemic stability of monist perspectives on which deep equality may be framed. The thesis concludes with some suggestions for future research. Two particularly exciting areas for future research are uncovered in the course of the analysis. First is the coherence between the work in this thesis and the jurisprudential paradigm of Wild Law. Second is the potential for the monist ontology of limited universal holism derived from scientific research to cohere with many diverse wisdom and ethno-­‐cultural traditions and in so doing increase the epistemic standing of monist ontologies. ABSTRACT Banks provide a valuable but inherently unstable combination of deposit‐taking and lending functions that were successfully held together for several decades after the New Deal by tough banking rules. The weakening of the rules after the 1970s promoted the displacement of traditional relationship‐based banking with securitized, arms‐length alternatives that encouraged banks to undertake activities about which bankers lacked deep relationship‐based knowledge of the risks. Ironically, this risky behavior, encouraged by loosened regulation, was reinforced by progressively tightened securities regulation, which (...) promoted stock‐market liquidity but also deprived large banks (and other publicly traded companies) of oversight by investors with “insiders’” knowledge. Both the underregulation of banking and the overregulation of securities were underpinned by economic theories that favored blind diversification in liquid, anonymous markets, and that ignored the value of relationship‐based knowledge and case‐by‐case due diligence. We propose a semantic analysis of the particles afinal (European Portuguese) and alla fine (Italian) in terms of the notion of truth unpersistence, which combines both epistemic modality and constraints on discourse structure. We argue that the felicitous use of these modal particles requires that the truth of a proposition p* fail to persist through a temporal succession of epistemic states, where p* is incompatible with the proposition modified by afinal/alla fine, and that the interlocutors share knowledge of a previous (...) epistemic attitude toward p*. We analyze two main cases, that of plan-related propositions and that of propositions without plans. We also discuss the connections between truth unpersistence and evidentiality. (shrink)

This paper looks at the documentary Five Broken Cameras (Palestine, Israel, France, Netherlands, 2011) to discuss the temporal implications of a quotidian under occupation. More specifically, the investigation casts light over the peaceful resistance against the Israeli wall in the Palestinian village of Bil’in portrayed by the lenses of Emad Burnat, a Palestinian villager who becomes the village´s filmmaker after the acquisition of his first camera. Upon the analysis, I claim that in the context of the Palestinian struggle, cinema is (...) both an integral part of the resistance and an instrument to structure the experience of time in an area fragmented by the occupation. A proposta desse artigo pretende discorrer sobre as manifestações de biopoder tendo como objeto de análise a personagem Gilda da série “Os últimos dias de Gilda”, exibida pela plataforma digital Globo Play. Gilda é uma mulher periférica e não se encontra nos moldes conservadores acerca da figura feminina e é alvo de vários dispositivos da influência do biopoder. A análise se apoia no entendimento de Michel Foucault sobre o tema ao compreender que o biopoder é uma condição previsível nas esferas (...) da convivência humana para controle dos corpos e subjetividades, mas, por outro lado, abre caminhos para a ocorrência de resistência desses corpos como modo de promover a visibilidade e reconhecimento público e político, como é o caso da personagem principal da série. Se narrativas fílmicas, ou ainda um gênero narrativo, podem mudar o que entendemos por uma cidade, pode a narrativa de uma cidade alterar filmes ou um gênero inteiro? É o que pretendemos investigar nesse ensaio a partir de análises de algumas comédias românticas hollywoodianas filmadas em Nova York após o 11 de setembro. Por décadas, a cidade foi a principal escolha para ambientar filmes leves e românticos da indústria americana. No entanto, após 2001 essa paisagem simbólica foi usada com cautela (...) e a maneira como se filmou e editou a cidade acompanha novas formas de narrar comédia, amor e intimidade no gênero. (shrink)

A proposta do artigo se desenvolve no intuito de apresentar as reflexões sobre amor pela perspectiva de Hannah Arendt. Mesmo não sendo um dos temas centrais das contribuições de Arendt, em alguma medida, a ideia de amor permeou seus estudos. As maiores reflexões nasceram com a ideia de amor mundi ao reconfigurar o pensamento de Santo Agostinho e reposicionar o amor mundano como construtor do mundo. Assim, a ideia de amor mundi de Hannah Arendt se aproxima da sua compreensão sobre (...) ação política dentro do espaço público para a edificação do mundo e se afasta do amor idealizado pela doutrina cristã enquanto demonstração de afeto privado. Recently, the second author, Briseid, and Safarik introduced nonstandard Dialectica, a functional interpretation capable of eliminating instances of familiar principles of nonstandard arithmetic—including overspill, underspill, and generalizations to higher types—from proofs. We show that the properties of this interpretation are mirrored by first-order logic in a constructive sheaf model of nonstandard arithmetic due to Moerdijk, later developed by Palmgren, and draw some new connections between nonstandard principles and principles that are rejected by strict constructivism. Furthermore, we introduce a variant of (...) the Diller–Nahm interpretation with two different kinds of quantifiers, similar to Hernest’s light Dialectica interpretation, and show that one can obtain nonstandard Dialectica by weakening the computational content of the existential quantifiers—a process called herbrandization. We also define a constructive sheaf model mirroring this new functional interpretation, and show that the process of herbrandization has a clear meaning in terms of these sheaf models. (shrink)

This article seeks to explore the theoretical contributions of Axel Honneth, particularly in his works, The Struggle for Recognition and Reification, aiming at diving deep into the debate on the contemporary ideological expressions and their incidence in the process of subjective constitution in teenage years. This particular interest springs from the need to interweave the concepts of reification, forgetfulness and recognition within a fruitful theoretical field in order to interpret a project work called Hip-Hop: cultures and identities, developed with teenagers (...) in a public school in the city of São Paulo, Brazil. From our point of view, the concepts of reification and forgetfulness are fundamental to identify how the conservative ideological expressions are present in the imaginary of adolescents in the contemporary world. Although rereading the concepts of reification and forgetfulness, as proposed by the author, is regarded as essential for understanding the ideological expressions that are based on and guided by consumption. However, even though we acknowledge Honneth's efforts toward moving forward with the concept of reification, it is crucial to emphasize the mediation concept Lukács explored in his work, History and Class Consciousness, so as to elucidate how the forgetfulness of the primary recognition relations is processed. This paper focuses on the interpretation of the Italian approximative adverb quasi 'almost' by primarily looking at cases in which it modifies temporal connectives, a domain which, to our knowledge, has been largely unexplored thus far. Consideration of this domain supports the need for a scalar account of the semantics of quasi (close in spirit to Hitzeman's semantic analysis of almost, in: Canakis et al. (eds) Papers from the 28th regional meeting of the Chicago Linguistic Society, 1992). When paired with (...) suitable analyses of temporal connectives, such an account can provide a simple explanation of the patterns of implication that are observed when quasi modifies locational (e. g. quando 'when'), directional (e. g. fino 'until' and da 'since'), and event-sequencing temporal connectives (e. g. prima 'before' and dopo ' after'). A challenging empirical phenomenon that is observed is a contrast between the modification of fino and da by quasi, on the one hand, and the modification of prima and dopo by the same adverb, on the other. While quasi fino and quasi da behave symmetrically, a puzzling asymmetry is observed between quasi prima and quasi dopo. To explain the asymmetry, we propose an analysis of prima and dopo on which the former has the meaning of the temporal comparative più presto 'earlier', while the latter is seen as an atomic predicate denoting temporal succession between events (Del Prete, Nat Lang Semantics 16: 157-203, 2008). We show that the same pattern of implication observed for quasi prima is attested when quasi modifies overt comparatives, and propose a pragmatic analysis of this pattern that uniformly applies to both cases, thus providing new evidence for the claim that prima is underlyingly a comparative. A major point of this paper is a discussion of the notion of scale which is relevant for the semantics of quasi', in particular, we show that the notion of Horn (entailment-based) scale is not well-suited for handling modification of temporal connectives, and that a more general notion of scale is required in order to provide a uniform analysis of quasi as a cross-categorial modifier. For humans, Artificial Intelligence operates more like a Rorschach test, as it is expected that intelligent machines will reflect humans' cognitive and physical behaviours. The concept of intelligence, however, is often confused with consciousness, and it is believed that the progress of intelligent machines will eventually result in them becoming conscious in the future. Nevertheless, what is overlooked is how the exploration of Artificial Intelligence also pertains to the development of human consciousness. An excellent example of this can be seen (...) in the film Being John Malkovich (1999). In the film, different characters have their perceptions altered as a result of hacking into the mind of John Malkovich, which produces sensations that may have remained hidden to their consciousness due to their dis-abilities. This article engages with the research question: Can the symbiotic relationship between humans and machines trigger an artificial consciousness for humans? An artificially created consciousness is the premise that a machine can generate knowledge about an individual that is not already present in the person. For the same purpose, the article takes the cinematic text Being John Malkovich by Spike Jonze for exploring concepts such as human/robot rights, virtual sex, virtual rape, and bodily disability, which are essential topics in the midst of increasing human- Artificial Intelligence interaction. The purpose of this article is to contribute towards the creation of a better understanding of Artificial Intelligence, particularly from the perspective of film studies and philosophy, by highlighting the potential of Artificial Intelligence as a vessel for exploring human consciousness.
